Terms of Service

SurgiSafe is a productivity tool for organizing surgical case photographs. A few things to be clear about before you use it:
- It is not a medical device, an electronic health record (EHR), or a HIPAA / HITRUST / SOC2 compliance solution. It is software that helps you file your own photos.
- You are responsible for what you put into it. Get patient consent before storing any identifiable information. Comply with the privacy and medical-records laws in your country.
- Don’t rely on SurgiSafe as the only copy of anything important. Phones are lost; accounts are locked out. Keep an independent backup of clinical material.
- Keep your phone locked and your Google account secure. SurgiSafe’s security ultimately rests on those two things.
- The app is offered as-is, by an independent developer. If something breaks or a sync fails, we’ll do our best to help — but you use it at your own risk.
The full terms below are the legally binding version. By installing or using SurgiSafe, you agree to all of it.

1. Acceptance
By downloading, installing, or using SurgiSafe (the “App”), you (the “User”) agree to be bound by these Terms of Service (the “Terms”) and the accompanying Privacy Policy. If you do not agree, do not use the App.
2. Service description
SurgiSafe is a mobile application that helps medical professionals organize photographic documentation of surgical cases on their personal device and synchronize those files to the User’s own Google Drive account. The App is published by Madhisoka, an independent software studio operated by Dr. Vijay Muthukumaran.
3. Medical & professional disclaimer
SurgiSafe is not a medical device, electronic health record (EHR), or a certified storage solution for protected health information. It has not been evaluated or cleared by any regulatory body (including the U.S. FDA, the CDSCO in India, or any equivalent authority). Nothing in or generated by the App constitutes medical advice, diagnosis, or treatment.
The App is not designed, marketed, or warranted to meet the requirements of the U.S. Health Insurance Portability and Accountability Act (HIPAA), the EU General Data Protection Regulation (GDPR), India’s Digital Personal Data Protection Act, 2023 (DPDPA), or any other healthcare data-protection regime, beyond the architectural choices described in the Privacy Policy.
4. Your responsibilities
By using the App, you represent and agree that:
- You are a qualified medical professional or a student/trainee under qualified supervision.
- You will obtain all consents required by applicable law before storing photographs or identifiable information of any patient in the App or your linked Google Drive.
- You will comply with the privacy, medical-records, and professional-conduct laws of the jurisdiction in which you practise.
- You will keep your device passcode-protected, your Google account secured (ideally with two-factor authentication), and your copies of clinical material independently backed up.
- You will not enter information about a patient into the App if doing so would violate any law, regulation, or contractual duty applicable to you.
5. Account & access
SurgiSafe does not create or maintain a Madhisoka account for you. The App authenticates with your existing Google account via Google Sign-In, solely to enable read/write access to a folder it creates inside your Google Drive. You remain the sole owner of that account and its contents.
6. License granted to you
Subject to these Terms, Madhisoka grants you a personal, non-exclusive, non-transferable, revocable, royalty-free license to install and use the App on devices you own or control, for your own professional purposes. The App and all intellectual-property rights in it remain the property of Madhisoka.
7. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent expressly permitted by applicable law;
- Resell, sublicense, lease, or commercially exploit the App;
- Use the App in a way that could damage, disable, overburden, or impair Google’s services or any third party’s services;
- Use the App to collect or store information about any individual without their informed consent;
- Use the App to violate any applicable law or regulation.
8. Subscriptions & pricing
SurgiSafe is currently offered free to install, with a 30-day trial of premium features included. Future paid tiers, if any, will be processed exclusively through the Google Play billing system and clearly disclosed before purchase. Refunds for in-app purchases are governed by Google Play’s policies.
9. Service availability
The App is offered on an “as available” basis. Functions that depend on third-party services (Google Sign-In, Google Drive API, your device’s network, etc.) may be temporarily unavailable for reasons outside Madhisoka’s control.
10. Modifications & termination
Madhisoka may modify, suspend, or discontinue the App or any of its features at any time, with or without notice. You may stop using the App at any time by uninstalling it and revoking its Google Drive access at myaccount.google.com/permissions.
11. Disclaimer of warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON- INFRINGEMENT, AND ANY WARRANTY OF UNINTERRUPTED, ERROR-FREE, OR LOSSLESS OPERATION. MADHISOKA DOES NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, OR PRESERVE OR RECOVER ANY DATA WITHOUT LOSS.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MADHISOKA AND DR. VIJAY MUTHUKUMARAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE APP, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF MADHISOKA EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR INR 1,000, WHICHEVER IS GREATER.
13. Indemnification
You agree to indemnify and hold harmless Madhisoka and Dr. Vijay Muthukumaran from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of (a) your use of the App, (b) any content you place into the App or your linked Drive, or (c) your violation of these Terms or any applicable law.
14. Governing law & jurisdiction
These Terms are governed by the laws of the Republic of India, without regard to its conflict-of-laws principles. The courts at Tamil Nadu, India, shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the App, subject to Section 15 below.
15. Dispute resolution
Before initiating any formal proceeding, the parties shall attempt in good faith to resolve any dispute by writing to madhisoka17@gmail.com. If the dispute is not resolved within thirty (30) days of such notice, either party may pursue remedies as permitted under Section 14.
16. Changes to these Terms
We may update these Terms from time to time. The “Effective” date at the top of this page reflects the most recent version. Material changes will be highlighted in-app where reasonably possible. Your continued use of the App after a change constitutes acceptance of the updated Terms.
